- User: Any person who uses the website, including clients and freelancers.
- Client: A user who posts projects or seeks freelancers/hirings for work.
- Freelancer: A user who offers services and completes projects for clients.
- Employee: A user who works for an organization or company under a formal or informal contract.
- Project: A job or task posted by a client.
- Subscription Fee: The fee charged by LEAD Creatives for using the platform.
- User Accounts
- Users must create an account to use certain features of the website.
- Users are responsible for maintaining the confidentiality of their account information.
- Users agree to provide accurate and complete information during registration and update their information as necessary.
- Posting Job
Clients may post jobs with detailed job descriptions, location, remuneration, contact details and level of competence.
- Clients
- Clients will have direct access to connect with freelancers or employees.
- Clients are responsible for reviewing and selecting freelancers or employees based on their qualifications and proposals.
- Payments
- All users are required to pay a membership fee to join the LEAD Creatives web app.
- LEAD Creatives uses a secure third-party payment app. Users agree to abide by the payment processor’s terms and conditions.
- Service Fees
- There are 3 membership plans monthly, half yearly and yearly.
- Membership fees are non-refundable.
- Dispute Resolution
- In the event of a dispute between a client and a freelancer, please contact info@lead-creatives.com for resolution.
- Intellectual Property
- Users retain ownership of the content they create and submit.
- By posting or sharing content on LEAD Creatives, users grant LEAD Creatives a non-exclusive and transferable license to use, publish, display, distribute and share the content on the platform and related promotional materials. This license remains in effect until the user removes the content from the platform, except where continued use is necessary for legal, administrative, or archival purposes.
- User represent and warrant that they have the rights to grant this license and that their content does not infringe on any third party rights.
- Confidentiality
- Users agree to maintain the confidentiality of all information related to projects, transactions, and any other proprietary or sensitive data obtained through LEAD Creatives.
- Users shall not disclose, share, or distribute any confidential information to third parties without the prior written consent of the disclosing party, except as required by law.
- Confidential information includes, but is not limited to, project details, financial transactions, business strategies, proprietary materials, and any non-public information shared between parties.
- Users acknowledge that any unauthorized disclosure or misuse of confidential information may result in legal action and liability for damages.
- Prohibited Activities
- Users agree not to engage in any activity on LEAD Creatives that:
- Violates any law or regulation.
- Violates any applicable local, national, or international laws, regulations, or legal obligations.
- Infringes upon the intellectual property rights, privacy rights, or any other legal rights of a third party.
- Involves fraudulent, deceptive, misleading, or harmful conduct, including but not limited to impersonation, misrepresentation, or unauthorized access to accounts or data.
- Disrupts, interferes with, or negatively impacts the proper functioning, security, or integrity of the LEAD Creatives platform, including attempting to introduce malware, hacking, or unauthorized data extraction.
- Violation of these terms may result in account suspension, termination, or legal action.
- Limitation of Liability
- LEAD Creatives shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, business opportunities, or reputation, arising from or related to the use of the platform, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if LEAD Creatives has been advised of the possibility of such damages. Users acknowledge that they use the platform at their own risk, and LEAD Creatives makes no warranties, express or implied, regarding the availability, accuracy, or reliability of the platform.
- Indemnification
- Users agree to indemnify, defend, and hold harmless LEAD Creatives, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Their use of the platform includes any content they post, share, or distribute.
- Any violation of these Terms and Conditions.
- Any infringement of third-party rights, including intellectual property, privacy, or contractual rights.
- Any misconduct, fraud, or unlawful activity committed by the user.
- This indemnification obligation shall survive the termination of the user’s account or use of the platform.
